I have several friends in S.F. who have partners that are in the U.S. on work or student visas, trying to immigrate legally. How does the new California law affect them? I assume they can be legally married in Ca. but cant leave the state or country when the visas up- or they will be deported. Any input from anyone?

Sun, May 18, 2008 - 11:20 AMOnce their visa is up they'll be living in the United States illegally. Immigration is a federal issue, so the state laws won't be much help. I'd recommend starting the steps to legally immigrate here, have their partner/spouse sponsor them. -

Wed, May 21, 2008 - 1:49 PMYeah...DOMA currently precludes the federal government from recognizing same-sex unions performed in any state, as far as I'm aware (and IANAL, so take my layperson's opinion with a whole shaker of salt).
A bi-national same-sex couple could sue for federal recognition of their marriage, but I have to say that I don't think the current Supreme Court would strike DOMA down...*le sigh*

Wed, May 21, 2008 - 12:31 AMI thimk that it would be a good idea to have an ottorney who specializes in immigration and gay rights. I would want to be with my partner instead of having to travel between the U.S. and their "birth" country.
